President William Ruto's plan to compensate victims of police brutality during this year's anti-government protests has been suspended by the High Court following a petition by human rights groups.
The government had proposed a Sh1.5 billion fund to pay families of those killed or injured during the June-August demonstrations that left at least 61 people dead and hundreds hospitalized.
But activists argue the move is little more than hush money designed to silence grieving families while shielding rogue police officers from prosecution.
"No amount of money can replace a life. What we want is justice. We want the killers arrested and charged," said Martha Ndung'u, whose 19-year-old son was shot dead in Kibera during the protests.
The case, filed by the Law Society of Kenya and three human rights organizations, accuses the state of attempting to "buy impunity" instead of holding security forces accountable.
So far, not a single police officer has been charged with murder, despite clear video evidence of extrajudicial killings. Instead, the state has offered cash.
Justice Teresia Matheka ordered the scheme halted pending a full hearing, stating that compensation without accountability sets a dangerous precedent.
"If the government is serious about justice, it should prosecute the officers involved, not pay off the victims," said Irungu Houghton of Amnesty International Kenya.
As the case proceeds, Kenyans are watching to see whether the courts can force a reckoning on a government accused of treating human rights violations like insurance claims.
